Floodplain Enforcement
Issued by the City of Lago Vista, November, 1998
The City recognizes that persons with property in the floodplain may' want to build on their property.
The City will enforce the floodplain policies according to the following:
All new construction In the floodplain will be required to adhere to the floodplain ordinances and regulations.
No new structures may have a finished floor below the 17' level and may not have any utll1t1es, ,electricity,
heating or ventilation below this level. Any accessible part of a structure below the 17' level may only be
used for parking, entry into the structure or limited storage.
Any structure In the floodplain that has damages equaling or exceeding the value of the structure by fifty'
percent (50%) or more as a result of flood, fire, tornado or other damage will be required to come into full
compliance with the floodplain policies. In some instances, structures may have to be elevated to raise the
finished floor above the 17' level.
Structures which have damages equaling forty-rune percent (49%) or less will not have to come into full
compliance with floodplain policies. Damages from flood, fire, tornado or other hazard will not be cumulative
from one hazard to the next.
Current structures that knowingly and willfully violate the floodplain policies or approved building plans will
be required to bring the structure into compliance, whether or not the structure has received damages that
equal fifty percent (50%) or more of the value of the structure.
In cases where property owners adhered to approved plans and the approved plans were later found to be
violation of the floodplain policies , the structures will not have to come into compliance unless the
structure Is fifty percent (50%) or more damaged.
Persons with property in the floodplain should be aware that violations of the floodplain policies may
cause a significant increase in their floodplain Insurance premiums. The City has been asked to Inspect
certain structures and to report on whether or not the structure is in compliance with the floodplain
policies. The City only reports the condition of the structure and does not determine the amount of the
Insurance premiums.
All persons with structures In the floodplain that have been damaged due to flood, fire, tornado or other
hazard must Inform the Build1ng Official and obtain a building permit before starting repairs on the structure.
No structure can be occupied until a certificate of occupancy has been issue.
